These Terms of Service ("Terms") constitute a legal agreement between you ("User" or "you") and Vertical Garden Planner developed by Rene Rueda Torres ("we," "us," or "our") governing your use of the Vertical Garden Planner mobile application ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.
By accessing or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the App. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.
The App is a gardening toolkit designed to help users plan, build, and maintain vertical gardens. Features include a plant catalog, garden layout editor, watering schedules, budget calculator, construction guides, and care tips. The App operates primarily offline and does not require an internet connection for core functionality.
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You agree not to:
All content, features, and functionality of the App — including but not limited to text, graphics, images, icons, plant data, construction guides, and software — are owned by or licensed to us and are protected by international copyright, trademark, and other intellectual property laws.
The App allows you to create garden layouts, save plant collections, and set watering schedules. This content is stored locally on your device. You retain ownership of any content you create. We do not access, collect, or store your user-generated content on our servers unless explicitly stated.
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that:
Gardening involves inherent risks. Always exercise appropriate caution and consult professional advice when undertaking construction projects.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes but is not limited to damages for loss of profits, data, goodwill, or other intangible losses. Our total liability shall not exceed the amount you paid for the App, if any.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.
The App may integrate with or link to third-party services (e.g., Google Play Store, analytics providers). We are not responsible for the content, practices, or availability of third-party services. Your interactions with such services are governed by their own terms and policies.
We may release updates to the App from time to time. These updates may include bug fixes, new features, or changes to existing functionality. You agree that we may update the App automatically or prompt you to download updates. Continued use after an update constitutes acceptance of any modified Terms.
We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms. Upon termination, your license to use the App is immediately revoked. You may also terminate by uninstalling the App from your device.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation or, if necessary, through binding arbitration.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
